These Website Terms of Use ("Terms") govern use of the Aurstream website and its content. The website is operated by Aurstream inc ("Aurstream," "we," "us" or "our"). Please read these Terms carefully. If you do not agree to them, you should not use the website.

1. Scope of these Terms

These Terms apply to the website, its educational materials and general communications concerning the website. They do not constitute an agreement to buy, sell, store, ship or transfer precious metals, open an account, or provide investment, tax or legal advice.

A transaction with Aurstream is governed by the applicable written quote, transaction agreement and related documents presented for that transaction. If those documents conflict with these Terms concerning a transaction, the transaction documents control. These Terms do not amend an accepted quote or an existing transaction agreement.

2. Eligibility and authority

You may use the website only for lawful purposes. A person entering into a transaction must be at least 18 years old, have the legal capacity to enter into the relevant agreement, and have the authority required to act for the owner of the metals or the relevant account. Acting for a company, trust, retirement account or another person does not itself establish that authority.

You are responsible for the accuracy of information you provide and for obtaining permission to disclose information belonging to another person. Do not impersonate another person, misrepresent ownership or authority, or provide information that you know is materially inaccurate.

Transactions remain subject to applicable identification, sanctions, recordkeeping and reporting requirements. We may request information reasonably necessary to verify identity, ownership or authority through an appropriate process. Aurstream cannot complete a transaction prohibited by applicable law.

3. Aurstream's role and professional advice

Aurstream's business concerns the purchase and selective sale of physical gold and silver bullion and coins. Aurstream is not a financial or investment adviser, securities broker-dealer, bank, trust company or IRA custodian, and does not provide investment management, commodity trading advisory, legal, tax or accounting services. We do not exercise discretionary investment authority over your assets or administer your retirement account.

Product information, market commentary, indicative ranges and quotations concern the products and terms of a potential metals transaction. They are not a personalized recommendation to buy, sell or hold an asset, make a retirement account distribution or transfer, or adopt a particular allocation or financial strategy. Website examples do not authenticate or appraise your items, establish account eligibility, or determine suitability for your financial circumstances.

You are responsible for your own financial decisions and for obtaining independent advice from appropriately qualified financial, tax and legal professionals. Website use, a general enquiry or a metals quotation does not establish an investment advisory, fiduciary, custodial or other professional advisory engagement. Nothing in these Terms excludes duties or protections imposed by applicable law or Aurstream's obligations under an accepted quote or transaction agreement.

4. Prices, quotations and transactions

Precious metals prices fluctuate. Market references, illustrative values and indicative ranges are not executable offers or guarantees of proceeds. A description of a product or service does not establish that a particular product is available for purchase or that Aurstream has agreed to buy a particular holding.

An Aurstream formal buyback quote is valid for two hours, as stated in the quote. Timely acceptance of a valid formal quote by an authorized person commits Aurstream to the quoted amount for the agreed products and quantities. That acceptance period is separate from the time required to arrange handover and complete the transaction. These Terms do not permit Aurstream to reprice an accepted quote merely because the market changes or the agreed metals arrive later.

The transaction documents specify the method of acceptance and the applicable delivery, verification and settlement requirements. Terms for a sale by Aurstream are set out in the documents for that sale; the buyback quotation rules do not automatically apply to sales. Browsing the website or sending a general enquiry does not accept a quote, place an order, authorize payment or instruct an IRA custodian.

5. Communications and information you provide

When you contact us, we may use the information you provide to address your enquiry and maintain the related business correspondence, as described in our Privacy Policy. Provide only information reasonably relevant to your enquiry. Do not send passwords, full financial account numbers, tax identification numbers or identity documents through general email.

You retain ownership of material you submit. You authorize us to use that material as reasonably necessary to handle your enquiry, comply with law and administer any separately agreed relationship. This authorization does not grant us a general right to publish your private correspondence or use it in advertising.

Providing an email address permits a response to the communication you initiated. It does not, by itself, constitute consent to promotional calls or texts. Any consent or disclosure required for electronic execution of a transaction document will be addressed separately; these Terms do not substitute for it.

6. Intellectual property and permitted use

The website, including its text, design, graphics, images, software, trademarks and other content, is owned by Aurstream or its licensors and is protected by applicable intellectual property laws. Except as expressly permitted here or by law, no intellectual property rights are transferred to you.

You may access the website and download or print reasonable portions for personal or internal business reference, provided you preserve applicable ownership notices and do not misrepresent the source. You may link to publicly accessible pages in a lawful manner that does not falsely suggest sponsorship, affiliation or endorsement. Other reproduction, commercial distribution, modification or use of our branding requires prior written permission unless otherwise permitted by law.

7. Prohibited conduct

You must not use the website to commit fraud, violate another person's rights, distribute malicious code, interfere with website operation, obtain unauthorized access, or circumvent security or access restrictions. You must not collect personal information about others through the website without lawful authority, or use automated methods to extract content in bulk for commercial exploitation without our written permission, except where applicable law permits that activity.

These restrictions do not prohibit ordinary browsing, lawful linking, assistive technologies or the exercise of rights that cannot lawfully be restricted.

8. Third-party websites and services

Links and references to third parties are provided for convenience or source attribution. We do not control independent websites and are not responsible for their content, availability or privacy practices. A reference to a third party does not, by itself, establish an endorsement, partnership or agency relationship. Your use of a third party's services is governed by the terms applicable to that relationship.

9. Accuracy, availability and access

We may correct errors, update content, maintain the website, or restrict access where reasonably necessary to protect the website, comply with law or address misuse. We do not guarantee uninterrupted access or that every item of general information will remain current. A correction to website content does not, by itself, cancel a transaction or change an amount already committed under an accepted quote.

Suspension or discontinuation of website access does not discharge obligations under a separate transaction agreement or limit rights available under applicable law.

10. Website warranties

To the fullest extent permitted by applicable law, the website and its general informational content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

This provision concerns website use and general informational content. It does not disclaim an express undertaking in a quote or transaction agreement, or a warranty or consumer protection that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by applicable law, Aurstream and its officers, employees and agents will not be liable for indirect, incidental, special or consequential losses arising from use of, or inability to use, the website, including lost profits, lost opportunities or loss of data, whether the claim arises in contract, tort or otherwise.

This limitation does not reduce an amount payable under an accepted quote or transaction agreement. Nothing in these Terms excludes or restricts liability for fraud, willful misconduct, gross negligence, violation of law, or any other liability or remedy that cannot lawfully be excluded or restricted. Where applicable law does not permit a limitation, that limitation applies only to the extent the law allows.

12. Claims arising from unlawful misuse

To the extent permitted by applicable law, you agree to indemnify Aurstream against third-party claims, damages and reasonable legal expenses to the extent directly caused by your fraudulent or willful misuse of the website or your knowing infringement of another person's rights through material you provide. This provision does not apply to ordinary lawful use, or to the extent a claim results from Aurstream's own acts, omissions or legal responsibilities.

We will give you reasonably prompt notice of a claim for which we seek indemnification and a reasonable opportunity to participate in its defense. No settlement may impose an admission or non-monetary obligation on you without your consent. Nothing in this section waives a non-waivable consumer right.

13. Governing law and disputes

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-laws principles. Subject to any mandatory rights you have to bring a claim in another forum, disputes concerning these Terms or website use may be brought in the state or federal courts with jurisdiction in Los Angeles County, California, and the parties consent to personal jurisdiction in those courts.

You may contact us to seek an informal resolution. Doing so is not a prerequisite to exercising a legal right and does not shorten any applicable filing period.

14. Changes to these Terms

We may revise these Terms by posting an updated version and changing the date shown above. Where a material change requires additional notice or consent, we will provide it as required by law. Revisions apply prospectively and do not retroactively alter an accepted quote, a completed transaction or an existing dispute. A separate transaction agreement may be amended only in accordance with that agreement and applicable law.

15. General provisions

If a provision is held unenforceable, it will be limited or severed to the extent necessary, and the remaining provisions will continue to apply. A failure or delay in enforcing a provision is not a waiver of the right to enforce it later. Provisions that by their nature should survive the end of website use, including intellectual property, liability and dispute provisions, survive to the extent permitted by law.

These Terms constitute the understanding concerning website use and supersede earlier website terms concerning the same subject. They do not supersede the Privacy Policy, mandatory legal protections, or a separately agreed transaction document. Nothing in these Terms creates a partnership, employment or agency relationship between you and Aurstream.
